Malta shares Construction's VAT treatment (standard 18%) and — critically — the same BCA licensing requirement under Legal Notice 166 of 2023: any contractor doing demolition, excavation or construction work, including subcontractors, must hold a BCA Licence and adequate insurance.

Legal Notice 166 of 2023 requires any contractor doing demolition, excavation or construction work — including subcontractors billing a main contractor — to hold a Building and Construction Authority (BCA) Licence and adequate insurance. Applications have been open since 24 July 2023, and licensing fees vary depending on whether the contractor works alone or employs staff.

Subcontractor-to-main-contractor invoicing is standard B2B

Subcontractor invoices to a main contractor are typically B2B between two Article 10 VAT-registered parties, so a standard Tax Invoice with 18% VAT applies. No confirmed Malta domestic reverse-charge mechanism for construction/subcontracting exists — do not apply a UK-CIS-style reverse charge here.
