Employment Separation Agreement Template
Updated on October 27, 2026
Employment Separation Agreement is not just a formatted document. It records a decision, obligation, request or factual finding that can affect pay, benefits, privacy, protected activity, licensing, ownership, safety or future disputes. This US master starts with those control points rather than the generic layout used by the Jotform source.
The source page is a useful demand signal, but its document is thin: The source agreement uses broad release language without a clear payment schedule, carve-outs, age-waiver warnings, agency-rights language, consideration or revocation mechanics. This rebuild makes the decision owner, scope, evidence, response route, storage and review mechanics visible before anyone signs or relies on it.
This master separates the commercial terms of an employment exit from the legal assumptions that make releases enforceable. It highlights payment, benefits, property, references, confidentiality, cooperation, release scope and revocation without pretending one form works in every state.

Nothing in this document waives wages, benefits, leave, anti-discrimination, anti-retaliation, privacy, consumer, copyright, safety or other non-waivable rights. No statement is a guarantee of legal compliance, employment, payment, performance, savings, safety or regulatory approval.
6. Confidentiality and storage
Store the completed document only in the file where it belongs and limit access to people who need it for the relevant business, HR, payroll, legal, client, licensing, safety or audit purpose. Store medical and other specially protected information separately where required.

What this template is for
Use it as a drafting framework for a negotiated separation that has been approved for the facts, jurisdiction and employee category. It should be reviewed before it is offered or signed.
Use the document when the organisation needs a dated record that a later reader can understand without guessing what happened. It separates facts from conclusions, gives the affected person a response path, and limits free text so the form does not collect sensitive material merely because a blank field was available.
The document is drafted for ordinary US private-sector use. It does not replace a state-mandated notice, government form, collective bargaining procedure, benefit-plan notice, technical audit protocol or regulator-prescribed document.
What the source document leaves out
The Jotform source is written as a printable artefact rather than as a controlled operational record. It does not adequately explain who may approve the document, whether a signature is acknowledgement or agreement, what evidence should be attached, where the completed record belongs, or what happens when law or a contract gives the affected person a stronger right.
That omission matters because these documents are usually used at the point where facts are disputed: a termination, a warning, a release, an employment check, a software licence or an audit. A polished PDF cannot repair an unclear decision trail.
Do not use it as a pressure document, as a substitute for final-pay obligations, or as a universal release. Do not promise confidentiality, non-disparagement or cooperation terms that conflict with protected rights.
How this improved version is structured
The document presents separation date, payments, benefits, property, references, release scope, preserved rights, confidentiality, cooperation, governing law, review and signatures as separate decisions.
The document uses named headings rather than numbered self-references. Optional blocks can be turned on or off by the workbench, so a sentence that points to “clause 7” would eventually point at the wrong text. Named clauses remain stable when optional content changes.
The page explains the document itself: the purpose, drafting choices, evidence, compliance checks, clause meaning and common misuse cases. It does not claim that downloading or signing the document creates legal compliance.
US legal and compliance points
The EEOC explains that waivers of age-discrimination claims by workers aged 40 or older must meet specific OWBPA requirements, including clear language and consideration rules. A separation agreement should never imply that a broad release automatically waives agency rights or future claims.
Federal guidance is only one layer. States and cities may add rules about final pay, personnel records, wage deductions, leave, privacy, restrictive covenants, background checks, energy reporting, consumer warranties or professional qualifications. The master therefore includes a state-law/work-location field and tells the user exactly where the federal source stops.
The template avoids overclaiming. It does not say that the document is attorney-approved, valid in every state, sufficient for every employer or a substitute for professional advice. It is a structured starting point that makes missing research visible.
Recordkeeping and privacy
Treat the agreement and negotiation record as confidential personnel and legal material. Send it securely, preserve versions and limit access; do not put medical or investigation detail into a general release.
Keep the completed document only where it belongs. A disciplinary or termination record may belong in a personnel file; a medical restriction may require separate confidential storage; a licence belongs with the product and customer records; technical audit data may contain building-security or commercial information. Mixing these files creates access, retention and disclosure problems.
Limit narrative fields to facts, requested terms, approvals, findings and next actions. Do not use the document as a place to store passwords, medical diagnoses, protected characteristics, unsupported opinions or settlement promises.
When not to use it
Do not use it for a mass layoff, older-worker group termination, government employee, union member or regulated settlement without the required process and review.
Do not use the template to waive non-waivable rights, punish protected activity, evade wage payment, misrepresent a person's employment, grant rights you do not own, make an unsupported safety claim, or present an indicative audit as a certified engineering report. Do not use it where another form or procedure is mandatory.
If the facts are disputed, high-value, safety-critical, medical, union-related, immigration-related, involving harassment or discrimination, involving a minor, or likely to lead to litigation, obtain appropriate review before the document is sent or signed.
Clause-by-clause guide
- Separation terms
- States the end date and distinguishes agreed terms from unilateral employment decisions.
- Consideration and payment
- Identifies what is offered, when it is paid and what conditions apply, without replacing final wages.
- Release scope
- Defines released claims and preserves claims and rights that cannot lawfully be released.
- Age-waiver mechanics
- Prompts the additional language, review period and revocation mechanics that may apply under OWBPA.
- Confidentiality and non-disparagement
- Limits promises so they do not suppress protected activity or lawful reporting.
- Cooperation and property
- Sets practical transition duties without creating an unlimited future obligation.
US compliance checklist
A release is a legal product, not boilerplate attached to an exit letter.
Check consideration
The payment or benefit offered must be identified and must be more than the employee is already entitled to receive.
Check OWBPA if applicable
Age-waiver rules can require specific disclosures, consideration, review and revocation periods. Do not improvise them.
EEOC — waivers and releases under OWBPAPreserve agency and protected rights
The agreement should not claim to stop a person from filing a charge, cooperating with an agency or exercising a non-waivable right.
Separate final pay and benefits
A release cannot be used to avoid final-pay rules or replace plan notices.
US Department of Labor — Last PaycheckCheck confidentiality wording
Use a narrow, lawful clause and preserve reporting, whistleblowing and other protected activity rights.
Give time for review
Do not rush signature; the appropriate review and revocation periods depend on the facts and applicable law.
How to complete this template
- Confirm the document and decision owner. Check that this document is the right record and identify the person authorised to approve it. If a regulator, court, union agreement, customer contract or professional standard requires a prescribed form, use that form first and retain this document only as supporting detail.
- Gather only necessary facts. Enter names, dates, roles, scope, amounts, conditions and next steps for the document. Keep facts separate from conclusions. Do not add diagnoses, protected characteristics, confidential credentials, speculation or copied material that does not belong in the record.
- Check law and policy before signing. Use the checklist to test federal requirements, then check the state or local rule, handbook, policy, collective agreement, benefit plan and contract that actually govern the matter. Treat a blank state-law field as a prompt for research, not as permission to assume federal law is enough.
- Give the affected person a fair response route. Give the employee or recipient a chance to correct factual errors, ask questions and raise a protected request or objection. Record whether a signature acknowledges receipt, accepts terms, authorises work, or merely confirms that the document was delivered.
- Store, review and supersede carefully. Put the completed document in the correct file, restrict access to people with a business need, set a review date where the arrangement continues, and replace or withdraw it when the facts, policy or law changes. Keep medical or other specially protected information separately where required.
Frequently asked questions
Is this a complete severance agreement?
It is a structured starting point, not a promise of enforceability. Release scope, consideration, age, jurisdiction and protected rights require review before use.
Can an agreement waive all claims?
No simple form can guarantee that. Some claims and agency rights are not waivable or require specific treatment, and a broad sentence may be ineffective or misleading.
Does severance replace final pay?
No. Wages and other amounts already owed must be handled separately under the applicable payroll and state rules.
What if the employee is 40 or older?
Special federal age-waiver rules may apply, including clear language, consideration and review or revocation mechanics. Use the EEOC guidance and obtain appropriate review.
Can confidentiality cover an agency complaint?
Do not draft it that way. Preserve lawful reporting, agency cooperation and other protected activity rights.
Should the employee sign at the termination meeting?
A person should receive the time and information required for a meaningful decision. Pressure can undermine both fairness and enforceability.
