Employee Termination Checklist Template
Updated on October 27, 2026
Employee Termination Checklist is not just a formatted document. It records a decision, obligation, request or factual finding that can affect pay, benefits, privacy, protected activity, licensing, ownership, safety or future disputes. This US master starts with those control points rather than the generic layout used by the Jotform source.
The source page is a useful demand signal, but its document is thin: The source checklist is a short list of generic offboarding tasks and does not distinguish voluntary from involuntary separation, pay status, benefits notices, access timing, property custody or the legal source for each task. This rebuild makes the decision owner, scope, evidence, response route, storage and review mechanics visible before anyone signs or relies on it.
This checklist coordinates the employment decision with payroll, benefits, access, property, records and communication. It is an internal control record, not a substitute for a state final-pay notice, COBRA notice, unemployment response or required agency form.

5. No waiver or unsupported guarantee
Nothing in this document waives wages, benefits, leave, anti-discrimination, anti-retaliation, privacy, consumer, copyright, safety or other non-waivable rights. No statement is a guarantee of legal compliance, employment, payment, performance, savings, safety or regulatory approval.
6. Confidentiality and storage
Store the completed document only in the file where it belongs and limit access to people who need it for the relevant business, HR, payroll, legal, client, licensing, safety or audit purpose. Store medical and other specially protected information separately where required.

What this template is for
Use it after the decision owner has confirmed the separation path and before, during and immediately after the last working day. Assign an owner and date for each operational task.
Use the document when the organisation needs a dated record that a later reader can understand without guessing what happened. It separates facts from conclusions, gives the affected person a response path, and limits free text so the form does not collect sensitive material merely because a blank field was available.
The document is drafted for ordinary US private-sector use. It does not replace a state-mandated notice, government form, collective bargaining procedure, benefit-plan notice, technical audit protocol or regulator-prescribed document.
What the source document leaves out
The Jotform source is written as a printable artefact rather than as a controlled operational record. It does not adequately explain who may approve the document, whether a signature is acknowledgement or agreement, what evidence should be attached, where the completed record belongs, or what happens when law or a contract gives the affected person a stronger right.
That omission matters because these documents are usually used at the point where facts are disputed: a termination, a warning, a release, an employment check, a software licence or an audit. A polished PDF cannot repair an unclear decision trail.
Do not use a checklist to make a termination decision without checking policy, contract, leave, accommodation, protected activity, wage and discrimination risks. Completion of boxes does not prove that every required notice was legally delivered.
How this improved version is structured
It is organised around decision approval, employee communication, payroll and final pay, benefits, access and property, records, references and post-separation follow-up.
The document uses named headings rather than numbered self-references. Optional blocks can be turned on or off by the workbench, so a sentence that points to “clause 7” would eventually point at the wrong text. Named clauses remain stable when optional content changes.
The page explains the document itself: the purpose, drafting choices, evidence, compliance checks, clause meaning and common misuse cases. It does not claim that downloading or signing the document creates legal compliance.
US legal and compliance points
The DOL notes that federal law does not require an immediate final paycheck, while some states do. COBRA or other benefit continuation notices may also apply. The checklist therefore records the state and plan checks rather than inventing one nationwide deadline.
Federal guidance is only one layer. States and cities may add rules about final pay, personnel records, wage deductions, leave, privacy, restrictive covenants, background checks, energy reporting, consumer warranties or professional qualifications. The master therefore includes a state-law/work-location field and tells the user exactly where the federal source stops.
The template avoids overclaiming. It does not say that the document is attorney-approved, valid in every state, sufficient for every employer or a substitute for professional advice. It is a structured starting point that makes missing research visible.
Recordkeeping and privacy
Offboarding exposes payroll, benefits, identity, security and personnel data. The checklist uses owner and completion fields rather than copying sensitive data into a general checklist.
Keep the completed document only where it belongs. A disciplinary or termination record may belong in a personnel file; a medical restriction may require separate confidential storage; a licence belongs with the product and customer records; technical audit data may contain building-security or commercial information. Mixing these files creates access, retention and disclosure problems.
Limit narrative fields to facts, requested terms, approvals, findings and next actions. Do not use the document as a place to store passwords, medical diagnoses, protected characteristics, unsupported opinions or settlement promises.
When not to use it
Do not use it for mass layoffs, plant closures, public-sector separations, unionised workplaces, regulated roles or cross-border exits without the applicable specialist procedure.
Do not use the template to waive non-waivable rights, punish protected activity, evade wage payment, misrepresent a person's employment, grant rights you do not own, make an unsupported safety claim, or present an indicative audit as a certified engineering report. Do not use it where another form or procedure is mandatory.
If the facts are disputed, high-value, safety-critical, medical, union-related, immigration-related, involving harassment or discrimination, involving a minor, or likely to lead to litigation, obtain appropriate review before the document is sent or signed.
Clause-by-clause guide
- Decision and authority
- Records who approved the separation, the stated basis and whether it is voluntary or involuntary.
- Communication plan
- Sets who delivers the message, when, what the employee receives and how questions are handled.
- Final pay and deductions
- Routes final wages, accrued amounts and deductions through payroll and the applicable state rule.
- Benefits and notices
- Prompts plan-specific continuation and other notices without pretending that one checklist is the notice itself.
- Access and property
- Coordinates system access, keys, devices, records and chain of custody.
- Records and follow-up
- Confirms file storage, reference policy, unemployment response and review of unresolved items.
US compliance checklist
Offboarding is a sequence of legal and operational controls, not one signature.
Confirm final-pay timing
Federal law does not require immediate payment, but state rules may. Payroll must identify the applicable deadline and amounts.
US Department of Labor — Last PaycheckCheck benefits continuation
Ask the plan administrator whether COBRA or another continuation notice applies and record the responsible owner.
US Department of Labor — COBRA continuation coverageReview protected leave and accommodation
Check recent leave, accommodation and complaint activity before finalising the decision.
US Department of Labor — FMLA topic pageReconcile deductions
Do not deduct property, loans or other amounts from final pay without checking wage and state-law restrictions.
Control access and property
Set a least-necessary access plan, preserve business records and document returned or missing property.
Keep required records
Use the organisation’s retention schedule and applicable employment recordkeeping requirements.

How to complete this template
- Confirm the document and decision owner. Check that this document is the right record and identify the person authorised to approve it. If a regulator, court, union agreement, customer contract or professional standard requires a prescribed form, use that form first and retain this document only as supporting detail.
- Gather only necessary facts. Enter names, dates, roles, scope, amounts, conditions and next steps for the document. Keep facts separate from conclusions. Do not add diagnoses, protected characteristics, confidential credentials, speculation or copied material that does not belong in the record.
- Check law and policy before signing. Use the checklist to test federal requirements, then check the state or local rule, handbook, policy, collective agreement, benefit plan and contract that actually govern the matter. Treat a blank state-law field as a prompt for research, not as permission to assume federal law is enough.
- Give the affected person a fair response route. Give the employee or recipient a chance to correct factual errors, ask questions and raise a protected request or objection. Record whether a signature acknowledges receipt, accepts terms, authorises work, or merely confirms that the document was delivered.
- Store, review and supersede carefully. Put the completed document in the correct file, restrict access to people with a business need, set a review date where the arrangement continues, and replace or withdraw it when the facts, policy or law changes. Keep medical or other specially protected information separately where required.
Frequently asked questions
Is this checklist a termination notice?
No. It is an internal coordination tool. The employee should receive the communication and notices required by the facts, plan, contract and applicable law.
Does federal law require an immediate final paycheck?
Not generally, but state law may require earlier payment. Payroll should confirm the work location and deadline before the separation is communicated.
Does every terminated employee receive COBRA?
No. Eligibility depends on the plan, employer size, qualifying event and other conditions. The plan administrator should handle the required notice.
Should access be revoked before the meeting?
It depends on the role, risk and process. Coordinate security and HR so access is restricted appropriately without losing records or creating an unsafe situation.
What if the employee is on leave?
Pause and check leave, accommodation, retaliation and discrimination risks before finalising the decision. A checklist cannot resolve those facts by itself.
Can the employer deduct unreturned equipment from final pay?
Do not assume so. Check the wage-deduction rule, agreement and written authorisation, and use a separate recovery process where necessary.
