Chicago Rental Lease Agreement Template

Updated on September 25, 2026

Chicago is not a generic Illinois lease market. The Jotform Chicago lease is only two document pages and contains serious defects: typos in the opening sentence, thin lead and radon language, no Residential Landlord and Tenant Ordinance summary attachment, weak security-deposit handling, no bed-bug education, no lockout warning, no proper fixed-term/month-to-month choice and an overbroad right for the landlord to possess tenant property.

This page is an existing-family regional expansion of the published rental-lease-agreement family. It does not redo other countries. The master below is written for Chicago residential leasing and cites the Chicago RLTO, City renters-rights page, EPA lead disclosure rule and Illinois radon tenant disclosure statute as core source anchors.

Start with RLTO coverage

Chicago Municipal Code Chapter 5-12 governs many residential rental agreements in the city, but it has exclusions. The lease should prompt the landlord to check whether the RLTO applies before choosing clauses, fees, deposit handling and remedies.

Where the RLTO applies, the lease should not hide the ordinance. Chicago requires an ordinance summary attachment, and the City renters-rights page points renters and landlords to the current summary and security-deposit information.

Security deposits need Chicago-specific detail

The Jotform lease says the security deposit will be returned after deductions for damages and utilities. That is not enough for Chicago. RLTO deposit provisions include handling, interest and transfer issues that can create significant liability if ignored.

This master separates security deposit from move-in fees, prepaid rent and other charges. It also asks for the financial institution, interest handling and itemization process where applicable.

Lead and radon cannot be one-line guesses

For most pre-1978 housing, the EPA lead-based paint disclosure rule requires landlords and agents to provide specific known lead information before renters sign. A lease should include the required disclosure process and pamphlet, not just a sentence saying the landlord is unaware of lead paint.

Illinois added specific tenant radon disclosure duties for leases entered into after the 2024 effective date of Public Act 103-298. The lease should prompt the landlord to provide the required pamphlet, records and disclosure form where the statute applies.

Use lawful access, repair and remedy language

Chicago rules address landlord access, repair duties, habitability and tenant remedies. A lease should not say the landlord can enter whenever convenient or that delayed notice makes the tenant responsible for every repair. It should state notice, emergency access and maintenance reporting in a way that can coexist with the RLTO.

The lease should also avoid self-help remedies. The RLTO includes a prohibition on interruption of tenant occupancy, so lockouts, utility shutoffs and property seizure clauses need careful limits.

Bed bugs, heat and local disclosures matter

The RLTO table of contents includes bed-bug education and notice of conditions affecting habitability. Chicago leases should include local educational materials and disclosures that apply to the property, not a generic hazardous-materials paragraph.

This regional page also keeps federal, state and city disclosures together so users can render a complete lease package rather than a two-page skeleton.

Frequently asked questions

Is this a 50-state lease?

No. This is a Chicago regional page under the existing rental-lease-agreement family. It is written around Chicago RLTO and Illinois disclosure issues.

Does the RLTO apply to every Chicago rental?

No. Chapter 5-12 has exclusions. The landlord should check coverage before using RLTO-specific clauses or deciding that an attachment is unnecessary.

Do I need the RLTO summary?

Where required, yes. Chicago materials point to the current Residential Landlord and Tenant Ordinance summary, and the lease should attach it rather than merely mention it.

Can I use a move-in fee instead of a security deposit?

Possibly, but it must be labeled and handled honestly. Do not call a charge a fee while using it like a refundable deposit, and check current Chicago and Illinois rules.

What lead disclosure is needed?

For most pre-1978 housing, federal law requires known lead information and a pamphlet before signing. Use the EPA/HUD disclosure process, not a one-line statement.

What radon disclosure is needed?

Illinois law now requires specific radon tenant information and disclosure materials for covered leases. Use the statutory form and pamphlet where applicable.

Can the landlord take tenant property after termination?

Do not rely on a broad lease clause allowing seizure. Chicago and Illinois rules may control possession, abandonment and remedies. Use lawful procedures.
