Do I charge sales tax or VAT on lawn mowing and landscaping?

Accepted Answer

In the US, roughly 20 states plus DC tax lawn/landscaping services — New York taxes routine maintenance but exempts qualifying "capital improvements" (new irrigation, retaining walls, permanent hardscape) with Form ST-124; New Jersey taxes landscaping with no such exemption; many states (e.g. California, Florida) don't tax it at all. In the EU/UK/CH, landscaping labour is standard-rated almost everywhere — Poland is the exception, at 8% for comprehensive green-area services (PKWiU 81.30.10.0) versus 23% for one-off or non-comprehensive jobs. Note: several gardener sites in the Netherlands still advertise a 9% rate on garden labour — that ended 1 July 2015; hovenier labour is 21% today (a separate 9% rate applies only to standalone planting invoiced as a goods delivery, see below).

How do I invoice recurring weekly mowing or a monthly maintenance contract?

Seasonal contracts (a full mowing season, or a winter snow-clearing contract) are commonly billed in equal monthly instalments rather than per visit. Use the service type & frequency field to show the instalment pattern, e.g. "Seasonal snow contract 2026/27, instalment 3 of 5", and keep the instalment amount consistent across the season even if actual visit counts vary month to month.

Should plants, soil and mulch be separate line items from labour?

Accepted Answer

Yes. It matters for two independent reasons: labour-only tax credits (Swedish RUT, German §35a, Finnish kotitalousvähennys, Danish servicefradrag) never extend to plants, soil, mulch or machine hire, only to labour — so an un-split invoice can cost your customer their credit entirely. Separately, several countries apply a reduced VAT rate to living plants while taxing labour at the standard rate (see the next question) — you can't even consider that reduced rate without a dedicated plants line.

A supplier says plants are taxed at a lower rate than my labour — how do I handle that on one invoice?

Accepted Answer

Belgium, Germany, Switzerland/Liechtenstein, Austria and Spain all apply a reduced VAT rate to living plants (e.g. Belgium 6% plants vs 21% labour, provided the invoice itemizes the split; Germany 7% vs 19%; Switzerland/Liechtenstein 2.6% vs 8.1%; Austria 13% vs 20%; Spain 10% vs 21%). The Netherlands has a narrower version: a stand-alone delivery/planting of trees, shrubs and perennials can qualify for 9%, but as soon as planting is bundled into a full garden-design or maintenance job the whole invoice reverts to 21%. This tool applies one tax rate per invoice, so it can't split 6%/21% (or 7%/19%, or 2.6%/8.1%, or 10%/21%) automatically. For a plants-heavy job where the reduced rate matters, either issue two invoices — one for plants at the reduced rate, one for labour at the standard rate — or use the standard service rate on this invoice and ask your bookkeeper to account for the split manually. Default here is always the standard service rate; the tax label flags "see FAQ" for every affected country so you don't miss it.

Can my customer get a tax credit for my gardening invoice?

Often, yes, for labour: France's crédit d'impôt for "petits travaux de jardinage" refunds 50% of the cost, capped at €5,000/year (so €2,500 credit), and requires a declared SAP number plus an annual attestation fiscale. Sweden's RUT-avdrag refunds 50% of labour (capped at 75,000 SEK/person/year) and requires an F-skatt registration and a clear labour/materials split. Finland's kotitalousvähennys and Denmark's servicefradrag (26% of labour, up to DKK 18,300/person for 2026, electronic payment only) work similarly. Germany's §35a gives 20% of labour costs back (up to €4,000/year for routine maintenance as a household service, or €1,200/year if it counts as a tradesman service for redesign work) — paid by bank transfer, never cash. None of these ever cover plants, soil or machine hire — only labour.

How do I invoice as a self-employed gardener without VAT/GST registration?

Leave the tax rate at 0% and add the required wording for your market — e.g. UK small-business exemption below £90,000 turnover, Germany's Kleinunternehmer §19 UStG, France's micro-entrepreneur franchise en base de TVA, or the Netherlands' KOR scheme. In Australia, show your ABN on every invoice even if you're not GST-registered, since invoices without one can trigger 47% no-ABN withholding by the payer.

When does CIS or a VAT reverse charge apply to landscaping work?

In the UK, routine gardening, tree surgery and landscaping are outside the Construction Industry Scheme (CIS) unless done as part of a wider construction project (e.g. a new housing development) — building walls, drives or patios as part of "routine landscaping" is itself treated as a construction operation and falls inside CIS. Where CIS applies between VAT-registered businesses, the VAT domestic reverse charge also applies (0% VAT shown, customer accounts for it directly). Belgium has a similar "btw verlegd" reverse charge for landscaping works on immovable property between VAT-registered businesses.

A quote or estimate (devis in France, Angebot in Germany, 見積書 in Japan) is a proposed price sent before work starts; the invoice is the request for payment sent after (or during) the work. Use the job/estimate reference field to link the two documents together, which is expected practice in most markets and legally significant in France (the devis underpins the tax-credit claim) and Japan (見積書-first culture dominates this trade).

How should I invoice tree work?

State the species and approximate height on each line (e.g. "Tree pruning — birch, approx. 8 m") — a convention borrowed from the Japanese trade but useful everywhere, since a customer with several trees on a property can't otherwise tell which line refers to which tree.

This also matters for tax credits: Sweden's RUT-avdrag explicitly excludes machine/tool hire from the deductible labour amount, while Germany's §35a does allow machine costs within the deductible tradesman-service amount — so keep equipment on its own line regardless of which scheme applies.
