Statutory Late Payment Interest on Maltese Invoices

When a commercial customer pays a Maltese invoice late, EU Late Payment Directive rules (transposed into Maltese law by Legal Notice 233 of 2012) entitle the creditor to statutory interest calculated as the ECB main refinancing rate in force on the first day of the relevant half-year, plus a fixed 8-percentage-point margin, locked in for that six-month period. For the second half of 2026 (from 1 July), that works out to 10.40% per year, following an ECB rate rise to 2.40% in June 2026. A fixed €40 compensation for recovery costs is also due on top of the interest, regardless of the invoice amount.
