A bicycle rental agreement sets out the terms on which a shop or operator rents a bicycle to a hirer: the bike, the rental period, the deposit, and — because riding carries a real risk of injury — how liability for that risk is allocated.
The widely circulated US free version of this document tries to release the shop from liability for injury or death with no exception for the shop's own negligence, and forfeits the entire deposit for a 20-minute late return. Gibraltar's government has explicitly decided not to make cycling helmets compulsory, unlike the rule it has introduced for e-scooters — so a rental agreement should reflect that a helmet is offered, not mandated. This template fixes the liability-release defect, offers a helmet without overstating it as a legal requirement, and replaces the disproportionate late-return penalty with a fee that fits the actual loss.

2. Helmet

3. Assumption of Risk
The Hirer acknowledges that cycling involves inherent risks, including the risk of bodily injury, even where the bicycle is in proper working order and reasonable care is used. The Hirer assumes these inherent risks.
4. Liability Release
The Hirer releases the Shop from liability for injury, loss or damage arising from the inherent risks of cycling described above. This release does not apply to, and does not excuse, any injury, loss or damage caused by the Shop's own negligence.
5. Hirer Responsibilities
- The Hirer shall lock the bicycle whenever it is left unattended.
- The Hirer shall report any defect discovered during the rental to the Shop promptly and shall not attempt repairs.
- The Hirer shall return the bicycle in substantially the same condition it was rented in, ordinary wear excepted.
- The Hirer shall not sublease the bicycle or permit any other person to ride it.
- The Hirer shall not carry passengers, ride under the influence of alcohol or drugs, or use the bicycle for any unlawful purpose.
6. Late Return and Damage
A bicycle returned after the return time above is subject to a late fee of per hour, up to a maximum of . The Hirer is responsible for the Shop's actual, reasonable cost of repair or replacement for any damage beyond ordinary wear.

If the bicycle is stolen while locked in accordance with the Hirer Responsibilities above, the Hirer shall cooperate with the Shop and any insurer but is not automatically liable for the bicycle's full value. If the bicycle is stolen while not locked as required, the Hirer is responsible for .

Gibraltar's government confirmed it will not introduce a mandatory helmet law for cyclists, while it has made helmets compulsory for e-scooter riders — a deliberate distinction based on the different speed and stability profile of the two vehicles. A rental agreement that implies a helmet is legally required for cycling would misstate the actual rule. Late-return and damage charges should fit the actual loss
