A bartending contract sets out the terms on which a bartender provides beverage-service at a client's event: the schedule, the fee, and — because the whole service involves serving alcohol to guests — who is responsible for confirming the premises is licensed, age verification, and covering the risk of alcohol-related harm.

The widely circulated US free version of this document leaves the bartender's certification as a blank line with no requirement it exist or be current. In Gibraltar, alcohol may only be sold by retail on premises that hold a licence under the Licensing and Fees Act, specific to that premises and only after a certificate of fitness — there is no separate national server-certification scheme, so the substance that matters is confirming the premises itself is properly licensed for the event. This template requires naming who is responsible for that confirmation, a real refusal-of-service policy, and liability insurance.

Bartending Contract

This Bartending Contract is made on between (the "Bartender") and (the "Client").

The Bartender agrees to provide bartending services for the event described above. The duration and scope of services under this Contract are limited to this event.

2. Licensed Premises

is responsible for confirming that the venue's licence under the Licensing and Fees Act covers the sale of alcohol at the event.

3. Age Verification and Refusal of Service

The Bartender shall request valid identification from any guest who appears to be under the legal drinking age before serving them, and shall refuse to serve any guest who cannot produce valid identification or who appears intoxicated.

4. Fee

Tips given directly to the Bartender by guests belong to the Bartender.

5. Insurance

The party responsible for alcohol service at the event shall carry liability insurance with (policy number ) covering the event.

6. Cancellation

Either party may terminate this Contract for the other party's material breach. The Client may terminate this Contract at any time by providing written notice to the Bartender; in that case, the Client shall compensate the Bartender for services rendered up to the date of termination, including non-refundable deposits or expenses reasonably incurred in preparing for the event. If the Bartender cannot attend the event, the Bartender shall notify the Client at least days in advance where possible, stating the reason, and shall make reasonable efforts to arrange a suitably qualified replacement.

7. General

This Contract is governed by the law of and constitutes the entire agreement between the parties. Any additional services agreed between the parties shall be documented in writing as an annex to this Contract.

The premises' licence, not a personal certificate, is what actually authorises the sale

Under the Licensing and Fees Act, a licence to sell wines, spirits or malt liquors by retail specifies the particular premises it covers, and no licence may be granted until the premises has a certificate of fitness. A blank line asking for a bartender's "certificate of ___" misses the point in Gibraltar's system — the document should confirm the premises' own licence covers the event, since that is what actually authorises the sale.

Age verification and refusal of service are the actual legal duty, not an afterthought

Gibraltar's licensing rules restrict supply of alcohol to minors, including conditional exceptions for lower-strength drinks supplied to 16 and 17 year-olds for on-premises consumption. The free version's only liability language is a bare self-exculpation for "poisoning and similar situations" — it never addresses over-service or refusal duties. This template adds an explicit age-verification and refusal-of-service duty.

Pay structure that can actually be administered

"____% of sales as a bonus" with no definition of sales and no distinction between a cash bar and a hosted bar is not a workable pay term. This template separates a flat per-event fee from an optional, clearly defined sales-percentage bonus that only applies where there are actual bar sales to calculate it from.

Does the bartender need a personal certificate to work an event?

Gibraltar doesn't run a separate national server-certification scheme like some other markets — what matters is that the premises itself holds a licence under the Licensing and Fees Act covering the sale of alcohol at that event.

Can any venue add a bar for a one-off event?

Not automatically — a licence to sell alcohol specifies the particular premises it covers and requires a certificate of fitness first. Confirm the venue's existing licensing position before the event.

Can the bartender refuse to serve someone?

Yes — and this template requires it: the bartender must refuse service to any guest who appears intoxicated or who cannot show valid ID confirming they meet the legal drinking age.

How does the sales-percentage bonus work if it's a hosted (open) bar?

It generally doesn't — a hosted bar where the client pays a flat amount and guests aren't charged has no bar sales to calculate a percentage from. The bonus only applies where the event has an actual cash bar generating sales.

Do tips belong to the bartender or the client?
